Welcome to 105MPH (105MPH LLC) These Terms of Service govern your access to and use of our website, training programs, and other digital services. By using our website or purchasing a product, you agree to be bound by these terms.

 

 

1. Digital Product Use

All products offered through 105MPH are delivered digitally. These include but are not limited to pitching plans, lifting programs, mobility guides, and mechanical breakdowns. Products are for personal use only and may not be shared, resold, or redistributed.

 

 

2. No Refund Policy

All sales are final. Due to the instant access provided with digital products, we do not offer refunds, exchanges, or cancellations under any circumstances. Please review all product descriptions carefully before purchasing. 

 

 

3. Purchase Eligibility

By making a purchase on our site, you confirm that you are:

  • At least 18 years of age; or

  • A minor with verifiable parental or legal guardian consent.

If it is later discovered that an individual falsified their age to bypass parental or guardian requirements, 105MPH reserves the right to revoke access and take appropriate action.

 

 


4. Training Disclaimer & Liability Waiver

Participation in any training plan from 105MPH is voluntary and at your own risk. Physical training carries inherent risks of injury, and by purchasing our products, you acknowledge those risks.

105MPH LLC and its team are not licensed strength coaches, physical therapists, or certified medical professionals, unless otherwise explicitly stated. Our guidance is for educational purposes only and should not replace medical advice.

All athletes must sign a separate digital Liability Waiver before receiving a customized program. Purchase of any product implies agreement to the terms of that waiver.

 

 

5. Chargeback and Fraud Policy

Initiating a chargeback after receiving digital services constitutes fraud. We reserve the right to:

  • Suspend access to all 105MPH services;

  • Pursue collections or legal action;

  • Report fraudulent behavior to payment processors and applicable authorities.

 

 

6. Intellectual Property

All content provided by 105MPH — including graphics, videos, training plans, and written content — is protected by intellectual property laws. Unauthorized reproduction, distribution, or modification is strictly prohibited. Do not share anything made or given to you by 105MPH unless permission is granted to share. Written consent, via text, email or paper copy must be needed.

 

 



7. Media Usage Rights

By submitting videos, testimonials, or training footage to 105MPH (via email, DM, or upload, etc.), you grant us non-exclusive rights to use this material in promotional content, educational resources, or marketing — unless otherwise specified in writing.

 

 

8. Modifications to Services

105MPH reserves the right to modify or discontinue any product, pricing, or service at any time without prior notice.

 

 

9. User Conduct

You agree to use our website and services lawfully and respectfully. Harassment, abuse, or misuse of any service, product, or communication platform will result in immediate termination of access. 

 

 

10. Governing Law

These Terms shall be governed by the laws of the State of Florida. Any disputes arising under or related to these terms will be subject to the exclusive jurisdiction of Florida state or federal courts.
